Please read these terms and conditions carefully before using the Prestige Watches website.

Interpretation and definitions

Capitalized words have meanings defined under these Terms. “Company,” “We,” “Us,” or “Our” refers to Prestige Watches, LLC, 12543 S Parker Rd Suite 212, Parker, CO 80134. “Service” refers to the website. “Goods” refers to items offered for sale. “Orders” means a request by you to purchase goods from us. “You” means the individual, company, or legal entity using the Service.

Acknowledgment

These Terms govern use of the Service and set out the rights and obligations of users. Access to and use of the Service is conditioned on acceptance of these Terms and our Privacy Policy. By accessing or using the Service, you agree to be bound by these Terms. You represent that you are over the age of 18.

Placing orders

By placing an order, you warrant that you are legally capable of entering into binding contracts. You may be asked to supply information including name, email, phone number, payment details, billing address, and shipping information. You represent that the information supplied is true, correct, and complete and that you have the legal right to use any payment method submitted.

Order cancellation and returns

We reserve the right to refuse or cancel orders for reasons including goods availability, description or pricing errors, order errors, suspected fraud, or unauthorized or illegal transactions. Goods may only be returned in accordance with these Terms and our Returns Policy.

Your right to cancel an order applies only to eligible goods returned in the same condition received, with instructions, documents, and wrapping included. You will not have a right to cancel for goods made to specifications, personalized goods, goods unsuitable for return due to health or hygiene reasons after unsealing, goods inseparably mixed with other items, or digital content where performance has begun with consent.

Availability, errors, and pricing

Goods may be mispriced, described inaccurately, or unavailable, and delays may occur when updating information. We reserve the right to change or update information and correct errors, inaccuracies, or omissions at any time without prior notice. Prices may be revised before accepting an order or after acceptance when affected by government action, customs duties, shipping charges, exchange costs, or matters beyond our control; in that event you may cancel the order.

Payments

Goods purchased are subject to one-time payment. Payment may be made through available payment methods such as Visa, MasterCard, American Express, PayPal, or other online payment methods. Payment cards are subject to validation and authorization by the issuer.

User accounts

When creating an account, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and notifying us of any breach or unauthorized use. You may not use a username that is unlawful, misleading, offensive, vulgar, obscene, or subject to rights of another person or entity without authorization.

Intellectual property and feedback

The Service and its original content, features, and functionality remain the property of the Company and its licensors. Our trademarks and trade dress may not be used without prior written consent. You assign all rights, title, and interest in feedback provided to the Company; if that assignment is ineffective, you grant us a worldwide, royalty-free, irrevocable license to use that feedback without restriction.

Third-party links

The Service may contain links to third-party websites or services that are not owned or controlled by the Company. We are not responsible for third-party content, privacy policies, practices, or any damage or loss related to use of those sites or services.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately.

Limitation of liability

To the maximum extent permitted by law, the Company’s liability and your exclusive remedy shall be limited to the amount actually paid by you through the Service or $100 if you have not purchased anything through the Service. The Company and suppliers shall not be liable for special, incidental, indirect, or consequential damages, including loss of profits, data, business interruption, personal injury, or privacy loss related to use of or inability to use the Service.

“As is” and “as available” disclaimer

The Service is provided “as is” and “as available” without warranty of any kind. To the maximum extent permitted by law, we disclaim warranties including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, accuracy, reliability, currency, and freedom from harmful components.

Watch warranty

New watches and products sold as new are guaranteed genuine-brand products in brand new condition and receive the applicable factory warranty from the date of purchase, depending on the brand. Warranty conditions are provided by the manufacturer and should be reviewed in the factory service booklet.

Pre-owned watches ship in the condition stated in the description and shown in website photos. Pre-owned watches, excluding consigned pieces, carry a 12-month limited warranty when disclosed. Every warranted pre-owned watch undergoes appropriate service review, and older watches may require complete service. Water resistance is stated in the description when applicable. Consigned timepieces are examined and tested but do not carry our warranty unless expressly stated.

Governing law and disputes

The laws of Colorado, United States, excluding conflict of law rules, govern these Terms and use of the Service. If you have a concern or dispute, you agree to first try to resolve it informally by contacting us. EU consumers may benefit from mandatory provisions of the law of their country of residence.

United States legal compliance

You represent and warrant that you are not located in a country subject to United States government embargo or designated as a terrorist-supporting country, and that you are not listed on any United States government list of prohibited or restricted parties.

Severability, waiver, and translation

If any provision is held unenforceable or invalid, it will be interpreted to accomplish its objectives to the greatest extent possible and remaining provisions will continue in effect. Failure to exercise a right or require performance does not waive future exercise of that right. If translated, the original English text prevails in case of dispute.

Changes to these Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice before new terms take effect. Continuing to use the Service after revisions become effective means you agree to the revised Terms.
